The Azerbaijan International Commercial Arbitration Court “On International Arbitration” was established in accordance with the Law of the Republic of Azerbaijan and other normative acts (BKAM) and was the first jury in our country to spread the idea of ​​arbitration. The activity of BKAM is the first step in the promotion and application of alternative methods of out-of-court settlement of disputes in Azerbaijan, due to the existence of a domestic legal framework and the accession of our country to international acts.
The reforms carried out in our country in the direction of building a civil, democratic state governed by the rule of law, as well as in the field of modernization of the judicial system have created a fertile ground for our country's integration into the world economic space and international law.
On November 9, 1999, the Republic of Azerbaijan ratified the New York Convention on the Recognition and Enforcement of Foreign Arbitration Awards of June 10, 1958. This is an important event in the judicial and legal reforms in our country, as well as simplified the procedure for recognition and implementation of the decisions to be taken by the ICRC in about 140 countries around the world. All this is an indicator of the state's creation of favorable legal mechanisms for the effective protection of economic and civil rights of foreign investors who have invested in the Azerbaijani economy. Today, it is safe to say that the legal framework formed in Azerbaijan has laid a solid foundation for the activities of an independent arbitration institution as an alternative method of dispute resolution. The confidence of foreign and local entrepreneurs operating in Azerbaijan and abroad in BKAM, which is a means of resolving disputes through jury, is growing.
Under such favorable conditions, BKAM, established 5 years ago, has expanded its activities, especially in the field of international relations. Germany, Romania, Egypt, Malaysia, Australia, Austria, United Arab Emirates, Italy, Ukraine and others. In general, mutual cooperation agreements have been concluded with institutions with rich experience in arbitration and mediation in more than 10 countries, and Azerbaijan has been worthily represented at international events in various countries. In order to promote international arbitration and out-of-court settlement of disputes in our country, 6 titles of literature in Azerbaijani, English and Russian languages ​​were published, and the newspaper "ARBITRAJ" was published.
The Azerbaijan Arbitration and Mediation Center (AAMM), reorganized in 2008 under the auspices of the officially registered Center for Legal Reforms, was formed on the basis of the International Commercial Arbitration Society, which has been operating since 2002. Currently, the International Commercial Arbitration Court under the AAMM; Azerbaijan Court of Arbitration; Baku Mediation and Reconciliation Service operates.
In recent years, methods of resolving disputes through mediation have been widely promoted and applied in the international arena. Along with the institution of arbitration, the activities of institutions that settle disputes through mediation (mediation) in an institutional manner also show positive results in international practice.
Taking into account such factors, AAMM, continuing the experience gained in previous years, aims to promote and apply out-of-court dispute resolution methods (mediation, friendly negotiations and mediation), as well as to develop the activities of BKAM. To this end, AAMM carries out awareness-raising activities on the advantages of out-of-court dispute resolution methods, applies the mechanism for resolving economic disputes through arbitration and mediation, and takes targeted measures to train professional arbitrators and mediators.
One of AAMM's activities is to exchange specialists with foreign arbitration and mediation institutions. Members of a number of international arbitration institutes are represented by BKAM arbitrators, as well as AAMM employees in a number of international organizations. This, of course, is commendable in terms of raising the level of professionalism of our national specialists.
Along with the latest innovations in our activities, the 5 years of BKAM's activity, especially in the field of international relations, and the successes achieved are reflected in our website presented to you. Of course, these are just the beginning of a long and difficult path. We set out with this desire: our goal is to use the favorable economic and legal base created by the Azerbaijani state to restore the violated rights of entrepreneurs operating in our country and abroad, to resolve disputes through out-of-court, friendly negotiations and arbitration.
