MILAN NATIONAL AND INTERNATIONAL ARBITRATION CHAMBER

AZERBAIJANI-ITALIAN COOPERATION IN ARBITRATION

At the end of December 2007, Alida Mahmudova, Secretary General of the Azerbaijan Arbitration and Mediation Center, visited the Milan National and International Arbitration Chamber in Italy and the National and International Arbitration Chamber under the Venice Chamber of Commerce. held talks on development. During the talks, an agreement was reached on concluding bilateral cooperation agreements with these arbitration institutions and exchanging experience and information in the future, organizing training courses and joint international conferences for arbitration, and implementing joint regional projects.
It should be noted that the legal norms in the field of arbitration in Italy are regulated by Section IV - Chapter VIII of the Code of Civil Procedure, which has been in force since 1940. Arbitration institutions also work closely with state courts during the arbitration process, and there is a mechanism for the recognition and enforcement of arbitral awards by state courts.
Under Italian national law, commercial disputes at the national and international levels between both individuals and legal entities can be heard through arbitration. In addition, the method of mediation is widely used in resolving disputes. Thus, according to statistics, in the National and International Arbitration Chamber of Milan in 2006, 102 disputes were considered in arbitration and 320 in mediation, of which 80% were national and 20% were international credit and finance, insurance, contractual obligations. , tourism, telecommunications, construction disputes.
In the National and International Arbitration Chamber under the Venice Chamber of Commerce, disputes are often settled through mediation. This means that the population in Venice has a high level of trust in the mediation process, and they find the mediation method more satisfactory in resolving disputes. Using international experience in the field of arbitration, we have also introduced new draft laws "On Arbitration Courts" and "On Dispute Resolution through Mediation" in order to improve our legal framework and experience in this area, to make more effective use of alternative dispute resolution. We are working purposefully to develop it. The development of such relations in the field of arbitration can be considered as one of the factors that have a positive impact on the Azerbaijani-Italian business environment and gain the trust of business organizations.

 


VENICE NATIONAL AND INTERNATIONAL ARBITRATION

On January 29, 2008, a cooperation agreement was signed between the International Commercial Arbitration Court of Azerbaijan and the National and International Arbitration Chamber of Venice. The Venice National and International Arbitration Chamber is an independent arbitration body established in 1990 by the Venice Chamber of Commerce and the Venice Bar Association of Accountants and Trade Associations. Since 2004, the Venice Chamber of Arbitration has continued the activities of Venca (formerly the Venice National and International Arbitration Court). The main purpose of the institute is to resolve the disputes of thousands of companies located in the region and engaged in trade with Europe, the Middle East. The Chamber offers flexible and fast procedures for those engaged in commercial activities. To this end, the Chamber has adopted the relevant Arbitration Rules to prevent delays and, above all, to determine the registration, management and arbitration fees, arbitration fees.
